On Transmutation of Ethical Basis for Environmental Law

目前,环境法学界有一种倾向,即以环境伦理学为其逻辑起点来阐释环境法律规范。笔者认为,环 境伦理学有不可克服的理论缺陷:其思维进路是非理性的,其理论本身是前后矛盾的。所以,我们应改 变传统的理论出发点,环境法应以发展伦理学为其伦理学基础。

Scholars on environmental law always regard the biological ethics as ethical basis for environmental law. This paper points out the theoretical inadequacy of biological ethics: its unreasonable epistemology path and contradictions in its theory system . It argues that environmental law should take sustainable development ethics as its ethical basis instead of biological ethics.
