中国亟待建立纺织品外观设计保护制度

Urgent need for China to enact the protection act of textile appearance design

TRIPS协议对纺织品外观设计提出了特殊的保护要求。中国还没有建立专门针对纺织品外观设计的保护制度。针对中国纺织品贸易中外观设计遭到侵权的情况,以及国内相关部门执法不护的窘境,强调对纺织品外观设计保护的必要性;研究和借鉴发达国家纺织品外观设计的保护制度,发出建立中国纺织品外观设计双重保护制度的呼吁,并提出修订相关法律制度的具体思考。

TRIPS had proposed a request particularly about the protection of textile appearance design. This paper claims strongly that it is an urgent task to enact a law protecting the textile appearance design, since there have been some tortuous acts in the appearance design rights of the textile products in the process of trading. After a review of what has been don in this area in some developed countries, some suggestions are put forward in this paper concerning how legal act should be established to provide a dual protection for textile appearance design.
