关于我国精神损害赔偿的几点思考

精神损害是侵害人身权案件中的普遍现象。对精神损害赔偿进行法理分析 ,指出我国对此问题在立法、司法中存在的局限 ,并采取相应对策 ,对推动我国法制建设 。

Mental damages is an universal phenomenon in the cases of refringing the rights of the person. This paper makes a juridical logic analysis of the compensation for mental damages, points out its limitations in the legislation and judicature of our country and the corresponding countermeasures to take. It has practical significance on promoting the legal system building of our country.
