On the Chinese Judicial Reforms in the Background of Globalization

发端于 15世纪前后的第一次全球化浪潮 ,并没有影响传统中国司法发展的固有格局 ;19世纪兴起的第二次全球化浪潮 ,则打断了中国司法的自然演进过程 ,催发了一个“西方化”色彩的司法体制 ;2 0世纪 80年代以来的第三次全球化浪潮 ,不仅引发了全球司法生活的重塑进程 ,而且推动了中国司法领域的革命性变化 ,形成了司法形式合理性与价值合理性的有机互动 ,创出一条既与全球司法文明准则相协调又具有浓郁中国风格的中国司法现代化道路。

Originated in the 15th century, the first globalization wave has not influenced the intrinsic structure of traditional Chinese judicial development. But the second globalization wave interrupted the natural development of the Chinese judicature in 19th century and urged the appearance of judicial system with western colors. Since the eighties of 20 century, the third globalization wave has not only influenced the global judicature lives, but also promoted the revolutionary change of Chinese judicature and formed the organic interaction of judicial formal reasonableness and the value reasonableness. China should bring about a judicature modernization road with a pronounced Chinese color and coordinated with the global judicature civilization criterions.
