摘要
现代公司对社会生活影响重大,建立独立的公司资产代表人制度已成为公司在新的条件下发展的关键。文章通过对公司与法定代表人之间代表关系的理性分析,以代表权理论为基础,构建代表权制度以解决当前存在的问题。
Modern corporations have a great influence on social life. The establishment of the independent representation -system of corporate assets has been the crux to the development of corporation. Through making a theoretical analysis of the relation between the corporation and the legal representative and basing on the theory of representation,the article constructs the representation-system to give a solution to the present problem.
