论新闻记者的拒证特权

On News Reporters' Privileges to Refuse to Provide Evidence:

新闻记者隐匿信息来源的拒证特权是我国目前立法和司法中的一个盲点。在新闻侵权诉讼中,如果强制记者披露信息提供者的身份,就个案而言,确实有利于案件事实的查明,但从整体而言,这势必会破坏记者和信息提供者之间的信赖关系,限制今后媒体采访的信息来源,导致新闻采访的基础丧失,最终威胁到新闻自由和市民社会的知情权。基于利益衡量,在新闻侵权诉讼中应当在立法中确认新闻记者隐匿信息提供者身份的拒证特权。

News reporter's privilege to refuse to bear witness in order to keep secret of sources of in formation in one blind point in China' s current legislation and administration of justice.In news infringement law suits,if the reporter is forced to reveal the identity of the source of information,so far as the individual case is concerned,it is indeed helpful to find out the truth of the case.But,on the whole,it will inevitably ruin the trust of the reporter by the informer,undermine information sources for the media's material gathering layer on,lead to loss of the ground of news coverage,and eventually threatens the freedom of press and the righr of the society to be kept informed.Weighing the gains and losses,the author holds that of the news infringement law suits legislation should affirm news reporters' privilege to refuse to provide evidence in order to keep sectet of the identity of information sources
