摘要
安乐死立法,是人类对待生命的正确的理性选择,是社会发展到一定历史阶段的必然结果。安乐死在西方一些国家已经立法并实施,而在我国,由于几千年传统的儒家文化思想习俗的影响,安乐死立法阻力颇大。但无论从安乐死的道德伦理的角度,安乐死的医学伦理的角度,还是从安乐死的法理学分析看,安乐死立法,对于健全我国的法制建设,完善对生命保护的法律体系,加大对生命的保护力度,不但具有理论上的必要性,也具有积极的现实意义。
Legislation is human's right and sensible choice for treating lives, and it's also a inevitable result of development of society. Euthanasia has been legislated and put into practice in some western countries, while in China, it doesn' t run smoothly for several thousands years traditional culture, thoughts of Confucius. But it is workable in terms of moral and medical ethics, as jurisprudence, and it can help us to improve the construction of the legal institutions, perfect the law system for protecting lives and enlarge the strength for life protection,so it is necessary and meaningful in practice.
