摘要
控权法律思想如一根红线贯串于洛克政治思想体系的始终。其中以个人权利为本位,以维护个人财产权为目的,以实行代议制民主为基础,以分权制衡为手段的控权理论,是洛克为人类政治法律思想宝库奉献的一份珍贵财富。他的控权法律思想的重心已经不再是人,而是国家或政府及其权力。控制的最终目的不在于防止统治者的恶,而在于敦促政府确保公民的自由和权利。辩证地分析其控权法律思想的内涵对于我国的权力法制建设具有重要的借鉴意义。
The legal thought of power-control run through Lock's political and legal thought system. Locke contributes much to the valuable treasure of human political and legal thought. His contribution lies in such power-controlling theories as that individual rights are considered the essential, safeguarding individual property is aim, executing representative democracy is the foundation, decentralization as well as checks and balances is the means. The focus of his power-control thought is no longer human being but state or government. The ultimate purpose of power control is not to prevent rulers from their vices but to promote government to ensure citizens′freedom and rights.
