对规划层次的战略环境影响评价是我国环境影响评价制度的一项重要内容,也是《环境影响评价法》在立法方面的一个重大突破,它为我国环境影响评价工作的顺利开展提供了权威性的法律依据。然而战略环境影响评价是对建设项目环境影响评价的进一步延伸和深化,是一个全新的领域,国内对其具体操作的基本理论尚缺乏广泛深入的研究,本文拟对其具体操作的实施和保障机制以及立法现状加以研究和评析,希望对其顺利实施有所裨益。

SEA (Strategic Environmental Assessment )on the programming is a very important constituent of China's EIA(Environmental Impact Assessment system)and also a great improvement on the legislation of China's Environmental Impact Assessment Law, which provides authoritative help for the work of SEA.SEA,the development of EIA on construction project,is a new field and its study and discussion are still scarce .This article is mainly about the legislation state of SEA.
