摘要
正义与道德有关,但是正义所涉及的不是个人道德,而是社会制度、政治体制和政府组织的正当性。与道德相比,正义与权力的关系更为密切。人们在对政治体制和社会制度作道义判断时,他们关注的主要是这个体制或制度如何对待身处其中的个人,其中最重要的问题就是体制或制度能否公正(正义)地对待所有的人。本文讨论了三个与“正义”有关的社会方面:法制秩序、社会契约和实在政治群体。
This paper proposes a distinction between the moral life of human beings and the moral nature of institutions, governments, and societies. A good society is not the sum total of moral individuals. Social arrangements are judged in terms of how people are treated under them and the question most asked is whether that treatment is just, and thus whether the social institutions are just. Justice is directed linked to power and three aspects of society: the rule of law, the social contract, and the existing political community.
