论新闻侵权之构成

On the Composition of the Press Infringement

新闻侵权因其案件纠纷剧增、涉及面广、社会影响大、消极影响无法预料和难以挽回而对我国的法治进程的危害尤为巨大。本文结合自己的教学和司法实践经验 ,对新闻侵权的概念进行了界定 ,提出新闻侵权除应具备一般侵权行为的构成要件之外 。

The increase of press infringement′s cases is harmful to the course of ruling by law .This article,united one ′s own teaching practice and judicial experience ,makes a definition on the notion of press infringement ,deems that ,besides general component condition of rort ,press infringement should have four other component conditions.
