我国产品责任法律体系之不足与完善

The Drawbacks and Perfection of the Law on Product Liability in China

产品责任法作为一新兴的法律领域,其体系存有不足之处。要从根本上遏制目前我国因产品质量问题所导致的侵权,完善产品责任法律体系,应从立法体例、"产品"的界定、产品缺陷的判定标准、产品责任的归责原则以及对受害者的救济方式等方面进行完善。

As a new law, the law on product liability has many Drawbacks.In order to contain the infringement acts caused by poor quality of product and perfect the system of the law on product liability, it's necessary to further perfect it in these aspects: legislative style, definition of product, the standard of defect, doctrine of liability fixation and the way of relieve to aggrieved party, etc.
