全球化时代的国家主权

State Sovereignty in the Era of Globalization

全球化所带来的“国界的祛除”使得每个国家的主权决定也并非可以完全自由做出 ,而是受制于现实存在的先决条件。全球性问题需要在全球框架下解决 ,这就需要部分主权的让渡 ,对国际条约的签署实际就是部分主权让渡的体现。维护和恢复世界和平不再是每个国家自己的主权决定 ,而是全球责任。当一个国家或地区发生冲突时 ,仅仅强调尊重国家主权而不加干预是不能解决问题的。如何干预须个案考量。

The“de-boundary”phenomenon brought about by globalization puts all countries in a position whereby they would rather take action under the restrictions of the reality of globalization than to be free to make any decisions on the basis of absolute state sovereignty.Global issues have to be solved within a global framework,which requires a partial transfer of state sovereignty.In nature,the signing of international treaties or agreements is a concrete manifestation of the partial transfer of state sovereignty.The restoration or safeguarding of world peace is a global responsibility rather than the sole business of each sovereign state.When a conflict takes place in a state or a region,the problem will never be remedied if respect for state sovereignty is emphasized and there is no intervention.However,how to intervene in internal conflicts should be considered on the case-to-case basis.
