摘要
侦查讯问是侦查人员在侦查阶段获取犯罪嫌疑人口供 ,核实其他犯罪证据的重要途径之一。不同的侦查制度和侦查模式下 ,警方讯问的理论基础不同 ,其讯问方法和规则以及对通过讯问所获得的口供的证据价值的评判标准也各不相同。在英美法的对抗式侦查模式下 ,犯罪嫌疑人面对警方的讯问有权保持沉默 ,被讯问人不得被强迫自证其罪 ,非法获取的口供和其他证据不被法庭采信 ;而在大陆法国家的职权式侦查讯问模式下 ,警方讯问犯罪嫌疑人时 ,其保持沉默的权利受到限制 。
In terrogationis one of most importantmethods forinvestigators to obtainaffidavit of suspectand checkother evide nce. Under different investigation system and pattern, people's theoretical bas is is different, and measurement standards for interrogative measures and regula tions, and value of affidavits. Under the Anglo American confrontational style i nvestigation pattern, a subject has right to keep silent when being interrogated by police who should not force the suspect to admit crime. The illegally-obtain ed affidavits and other evidence will not be accepted in court, while in contine ntal countries, a suspect's right to keep silent when being interrogated is res tricted and illegal evidence is not eliminated.
