摘要
制定《社会保险法》在我国已提上立法日程,并为《劳动和社会保障事业发展第十个五年计划纲 要》所肯定,但这一立法思路并非社会保险立法的最佳模式,且难度很大。比较可行的选择是按 社会保险的各项具体内容制定社会保险单行法律,这样既可及时满足社会保险事业发展的客观 需要,又能克服现行社会保险立法的诸多弊端。
The legislation of Social Insurance Law of PRC has been taken on the agenda. It also has been supported by The Outline of the 10th Five - year Plan of the Development of Labour and Social Security Cause. However, such a way of legislation isn' t the best pattern and has more difficulties in performing. The more feasible choice is to legislate the branch laws of social insurance. So that it cannot only meet the need of the development of social insurance cause, but also overcome the shortcomings of the current legislation of social insurance.
