The system of silence right is an importation which naturally embodies western humanism and values.Value trend and system function of silence right explored will be helpful for us to understand and master this system which also commands us to think over in the transplantation of law.From this point of view,the article rebuts the relative scholastic points and sufficiently demonstrates the necessity and feasibility of the establishment of silence right in our country.Then the author puts forward the whole design thinking of the regulation of silence right in China,combining the present situation of our country.
