Some Supervisory Issues Concerning the Foreign Capital's Participation into China's Banking and Some Policy Suggestions

根据加入世贸组织的承诺 ,我国将于 2 0 0 7年全面开放银行业。为了抢占有利形势 ,许多外资银行已通过参股中资银行的方式开始了战略布局。此举有利于实现双方的优势互补、互利互惠。但目前相关法律和管理办法的缺位 ,既限制了被参股行业拓展的可操作性 ,也易给宏观调控带来隐患。因此 ,管理部门应坚持审慎监管的原则 ,抓紧法律法规的制定和完善。

In accordance with the commitment of entering WTO, China is to open banking business overall. In order to get the better of others, some foreign banks have begun their strategic layout by participating shares into China's bank. This strategy is good to play each other's advantages and is beneficial to both parties' interest. But the vacancy of related laws and regulations not only hinders the development of the share-participated banks, but also brings the potential issues for the macro-adjustment and control. Therefore the administrative departments should stick to the principle of cautious supervision and quicken the establishment and perfection of related laws and regulations.
