论国民待遇原则对我国外资法重构的影响

National Treatment Affects the Foreign Investment Law of China

国民待遇原则是WTO协定最重要的原则之一。入世后,我国现行的对外资的待遇制度已经与WTO协定表现出明显的不一致。能否在现有的基础上更大规模地引进外资,将国民待遇原则贯穿于我国的外资法中已成为完善我国外资法的关键所在。

National Treatment is one of the most important principles in WTO Agreement.Since China entered WTO,some stipulations in the foreign investment law in force have become incongruous with WTO Agreement.Thus,it is a key to improvement of the foreign investment law whether we can absorb foreign investment on an even larger scale,and whether the principle of National Treatment can be embodied in the foreign imvestment law of the country.
