略论中国的选择性保障措施

A brief study in the selective measures of safeguard taken by China

我国在《入世议定书》中承诺的过渡性保障措施本质上是一种选择性的保障措施,其规定的实施条件比WTO《保障措施协议》要宽松,这是一种不公平的规定,我国应在履行协议时通过解释争取变更这种不利处境。

The transitional safeguard measures promised by China in 'The Protocol for the Chinese Entry into WTO' are in nature a kind of selective safeguard measures. The enforcement qualification for such measures is broader than what has been specified in WTO's 'Agreement on Protective Measures', and seems to be an impartial clause. China should make effort to change such an unbeneficial situation by explanation when it fulfills this agreement.
