论我国侦查监听立法的完善

On Perfection of Legislation about Investigating Monitor

随着现代科学技术的迅猛发展 ,侦查监听技术日益成熟并被广泛采用。由于侦查监听的采用与宪法所保障的公民的的言论自由、通讯自由、隐私权等基本权利紧密相关 ,在使用时 ,常会发生“控制犯罪”与“保护人权”的利益冲突。因此 ,必须规范侦查监听法律制度 。

With the rapid development of science and technology, the investigation monitor technology has been becoming mature and been widely used. The applications of investigation monitor are closely related to the fundamental rights, such as freedom of speech and communications, privacy etc., which are secured by the Constitution so the control over offense often falls in conflicts with the security of human rights. Therefore, the legal system of investigation monitor must be regulated in order to secure the legal rights and interests while the offenders are punished.
