摘要
从立法过程、条款内容及英译文角度对假冒专利与冒充专利两个概念加以区分.鉴于第三版专利法(patentlaw)及实施细则(implementingregulations)规定,对假冒专利与冒充专利行为分别给予界定,在对照两种行为法律责任的基础上,探讨如何辨析假冒专利(passingoffthepatentofanotherperson)与冒充专利(passingoffpatented)行为.
The paper discusses the difference between passing off the patent of another person and passing off patented. According to the implementing regulations and the rule of the third version of Patent Law, the paper defines the action of passing off the patent of another person and passing off patented.The paper also discusses how to discriminate passing off the patent of another person from passing off patented.
