论新商标法的驰名商标保护制度

On the Protection of Well-known Trademarks of New Trademark Law

驰名商标制度的确立是我国商标法的一个里程碑。新商标法明确规定有条件地保护未注册驰名商标,对注册驰名商标实行跨类保护。对驰名商标应一视同仁,跨类保护的范围应扩大至未注册驰名商标。关于驰名商标的认定模式,提议适当引入社会认定以确保公正的真正实现。

The establishment of the system of well -known trademarks is a milestone of the Trademark Law in our country.The new trademark law clearly stipulates the protection of Well-known trademarks which are not registered and the protection of registered well-known trademarks going beyond one Class.However,the author holds that all well-known trademarks should be treated equally and the scope of protection should be extended to well-known trademarks.As for the determination of well-known trademarks,the author recommends introducing appropriate social determination to ensure the realization of justice.
