试论酌定不起诉的适用条件及其完善

酌定不起诉是不起诉制度的一项重要内容,它是法律赋予检察机关的自由裁量权,但法律对这一自由裁量权的适用条件限制非常严格,这与刑法中有关量刑的规定不太协调,借鉴国外立法例,应适当放宽不起诉的适用条件,从制度上完善我国的不起诉制度。

Deliberate nonprosecution is an important content of nonprosecution system.It is the procuratorical organ's power of free decision that the law gives the procuratorical organ.But the conditions that suit to the nonprosecutive power are very strict,this don' t cohere with the provisions of criminal law.we combine with the foreign legislation and judical precedents.we advocate that it should widen the conditions of nonprosecution and perfect the nonprosecutive system of our country from the system.
