On Product Responsibility Counterplea of Producers

市场经济条件下,产品生产者和消费者的信息是不对称的,为保护受害人的利益,生产者的产品责任归责法律多规定为严格责任原则,严格责任以其独特的补偿功能实现着受害人保护,但同时也会加重产品生产者的负担,窒息生产者的积极性。为平衡生产者和消费者的利益,法律规定了生产者产品责任的抗辩事由,因而从比较法的角度对欧美国家的产品责任抗辩事由加以比较分析,对我国生产者产品责任抗辩事由的立法完善提出建议。

In the market economy, it is not parallel for producers and consumers to get the same information. In order to protect the interests of 'victim' , a strict liability principle is stated in the law, which realizes the goal of protecting consumers with its remedial function. On the other hand, it burdens the producers overwhelmingly and constrains producers' activity. Therefore, counterplea for producers are stipulated in the law to balance interests between producers and consumers. This essay is to analyze counterplea stipulated in Europe and American law with perspective of comparative law so as to provide advice for its relative legislative perfection in China.
