摘要
我国现行继承法对遗嘱自由过于放任 ,这与婚姻家庭法养老育幼义务不对应 ,与我国宪法权利义务一致性原则和整个法律体系不谐 ,与中国传统继承法律、家庭伦理道德不符 ,与国际继承立法冲突过大 ,不好接轨 ,有可能损害我国人民和国家的利益 ;建议修改我国现行继承法 ,给特留份以应有位置 ,这也是与婚姻家庭法相配套的反对“包二奶”
Based on the research into much material, modern and ancient, Chinese and foreign, about testament, this paper holds the viewpoint that the freedom of testament in the present inheritance law of China is too excessive, not being harmonious to the present family law and constitution of China, and not being in conformity with Chinese traditional ethics and international trend of inheritance law. It proposes to amend the present inheritance law of China and newly use the institution of legal portion.
