论司法鉴定结论及其证据价值

司法鉴定结论是法定的七种证据之一 ,因其具有侦查指向价值、确实化价值、证明价值而在司法活动中起着重要作用。随着科学技术的发展 ,司法鉴定的范围更大、对象更多 ,鉴定结论证据的地位越来越突出。本文分析了鉴定结论的特殊性及其鉴定结论的价值构成 ,并从司法实践的角度提出鉴定结论在实际应用过程中的价值倾向。

Justice-identify-conclusion (JIC) is one of seven legal evidences. JIC has spy-directing value, fact value and proving value, the role of a JIC is more and more important. For the development of technology science, a JIC applies is more vast, its status is more and more outstanding. This article has introduced the scope, the object referred to the justice-identify-conclusion (JIC) in accidence, has analyzed the difference between the JIC and the other forms of evidences (particularity), has discoursed the JIC upon the structure of value in judicatory practice, and put forward the tendency of its value in practical application.
