浸透着仁爱精神的孔子法思想——从仁、礼、刑的进路来解读《论语》

The Confucianism Thought of Law Full of Humanities——Reading ?Lunyu? from the Access Road of Jen Li and Law

本文从探讨《论语》中“仁”的涵义出发 ,高度概括和评价了作为孔子伦理体系核心思想的仁爱精神。在此基础上笔者通过对“仁礼关系”、“道礼关系”以及“礼”的起源、特征等方面的分析 ,从宏观方面对孔子伦理法思想及其实现方式作了阐述 ,并且以仁学精神为指引 ,对本书中提到的有关“刑”、“讼”的章句作了解释和分析 ,从而较为完整地揭示了孔子法思想的大观与微观。

Starting with the concept of “Jen”, the author has given a high evaluation to humanities spirit which is the core of Confucianism moral thought system. Here from we have expounded the means of realization of the Confucianism moral thought in macroscopic aspect according to the analysis of “Jen-Li” relationship “Dao-Li” relationship and the origin characteristic of “Li”;over and above,guided with the Confucianism spirit,the author brings forward a explanation and analysis to the sentence of penalty and lawsuit, so as to revel the spirit of law of Confucianism moral thought in macro-thought.
