论反倾销规避与反规避措施

随着各国反倾销立法的完善和反倾销力度的加强 ,被裁定征收高额反倾销税的不甘心失去进口国市场的出口商必将采取各种方法进行规避 ,而且其手段也更为隐蔽 ,使得进口国防不胜防。反规避措施自上世纪 80年代出现以来 ,已越来越为各国所重视。为了维护反倾销立法的尊严和避免规避行为对我国产生的不利影响 ,研究规避及其方法、借鉴欧美反规避措施立法经验 ,弥补我国立法的不足无疑是入世后中国面临的又一紧迫的问题。

With the improvement of legislation on anti-dumping and more stress putted on dumping action in many countries,exporters who have been punished high anti-dumping tax will avoid such punishment through various methods in order to maintain the obtained market share. As the development of technology ,those become too hidden to be discovered by import country. Since 1980’s,many countries have pay more and more attention to anti-circumvention measures. In order to protect the dignity of law and avoid the negative influence of circumvention,it is also a urgent subject for China to introduce and absorb beneficial experience of EU and American and improve Chinese anti-circumventing legislation .
