摘要
救助报酬的分配是海难救助制度中一个至关重要的方面。分配方案的合理、公正与否直接影响鼓励救助这一目的能否实现。分析了我国海难救助报酬分配的现状,比较、借鉴国际救助公约和英、美等国国内法相关规定,为完善海难救助报酬分配提出了几点修改建议。
The apportionment of sea-salvage remuneration is a pivotal aspect in maritime salvage system. Whether the apportionment scheme is reasonable and equitable will effect the realization of encouraging salvage directly. The paper analyzes the present status of apportionment of sea-salvage remuneration in China, compares and uses the provisions of relative international conventions and other countries' national laws for reference, and proposes some suggestions for apportionment of salvage at sea remuneration.
