The Evidence for Assessing the Capacity of Testament in Forensic Appraisal(The Case Report in Appendix)

本文通过对以下四个方面的讨论 ,提出了在司法精神鉴定中关于遗嘱 (遗赠 )能力鉴定的依据 :1 遗嘱 (遗赠 )能力与民事行为能力的关系 ;2 遗嘱 (遗赠 )能力的鉴定要点 ;3 关于在遗嘱能力鉴定中引入量化指标的问题 ;4 继承人继承能力对遗嘱 (遗赠 )

This study bring forward the evidence for assessing the capacity of testament through the discussing on four aspects:1.The relationship between the civil capacity and the testamentary capacity.2.The outline of the assessing to the testamentary capacity.3.The using of the measurable index for the assessing to the testamentary capacity.4.How dose the successive capacity of the heir at low influence the assessing to the testamentary capacity.
