随着档案文献数字化工作的开展 ,档案文献版权问题也出现了新的特点。在档案文献数字化过程中要解决好版权问题 ,首先应进行版权认定。它主要包括档案文献版权状况认定、档案文献版权权属认定以及档案文献版权权利内容认定三个方面。其次 ,档案文献数字化过程中要进行版权保护 ,关键就是要解决好“权利许可”的问题 ,其主要途径有 :寻求版权人免费许可 ;同版权人签订许可使用合同 ;通过版权集体管理组织获得权利许可 ;

With the development of archival digitization activiti es ,there are some new characters appear in copyright issues of archival literature .In order to resolve these copyright issues in the process of archival digitizat ion, the archiving institution should authenticate the copyright of their collec tions at first.They include that authenticating what kind of archival literature in copyright,discovering who own the copyright for these literature and authent icating what kind of copyright rights which might be infringed in the process of archival digitization.Secondly,if the archiving institution want to protect the ir literature's copyright,the key measure is to obtain 'right permission' fr om copyright owner.The main approaches to obtain 'right permission' include t he following:requesting free permission from copyright owner;entering into the l icensing agreement with copyright owner;obtaining right permission through the c ollective management organization of copyright;establishing intellectual propert y union of the archiving institution.
