BOT方式是我国利用外国资本进行基础设施建设的新型投资方式,涉及中外各方签订的一系列合同,其中最重要是BOT基础协议和BOT特许权协议;各类合同法律性质的差异,导致相关的法律适用不尽相同。

As a new Way in investment and financing,BOT plays an important role in introduction of foreign capital, especially the case with China?蒺s infrastructure.The paper.points out that BOT involves a series of contracts or agreements signed by Sino-foreign parties, the most important of which are the agreements of the Basic Agreements and the Licensing Agreements. It warns that due to the different contractual laws in different countries, the pertinent legal applicaility is different.
