个体权利是人类权利的惟一实存形式,一旦个体权利成了社会的权利,社会也就构成了权利的实在形式,这时人的个体权利就可能成为一种虚假的形式而遭受侵犯。侵犯人类个体权利的行为一可能来自个人,二可能来自政府,前者容易识别和纠正,后者则往往因少数人借“集体权利”、“社会权利”和“国家权利”之名行侵犯个体权利之实而极具隐蔽性,有时可能置受害者于被动和无奈之地。

Individual right is the only hasform of the human being right in fact.Once the right becomes the right of the society,the so-ciety has formed the really form of the right.People’s individual right becomes a kind of false form and will be infringed unavoidably at this moment.The be havior infringing mankind individual right comes from the individual and the government,the former is easy to discern and to be punished,the latter often infringe individual right in the name of“collective right ”,“social right ”and“national right ”,have stronger duplicity and disguise,put the victim in the passive and helpless place.
