违法性认识解读

The interpretation of illegal cognition

将违法性认识作为犯罪故意的内容,这是罪刑法定原则的题中应有之义。但对违法性认识本身如何理解,理论中尚有缺乏明晰之处。基于理论的完善与实践的需要,对违法性认识应注意三点:一、对违法性认识的主体应予明确化,即区分认识主体与评价主体;二、对违法性认识中“法”的理解,应采用违反法律规范的认识说;三、在违法性认识中,犯罪客体只是一种评价性要素,并非认识主体的认识内容。

It is the nature in the principle of legalization condemnation that takes illegal cognition as the contents of intentional offence.However,how to understand the subjects and the contents of illegal cognition remains obscure in the theory.Due to the perfection of theory and the demand of practice,it will be of importance to clear the subject in the cognition of illegality,the cognitional subject and appraisal subject,namely,to understand the meaning of“law”in the cognition of illegality and to realize that the object of crime is not the content of cognitional subject but an element in evaluation.
