摘要
检察权的独立性存在障碍性因素,由宪法对检察权的独立性加以规定是必要和合理的。检察权的独立性有外部独立与内部独立两个方面,内部独立涉及检察官与检察长之间的关系。检察权的独立行使有其相对性,必须要处理好其与执政党的领导、与人大监督的关系。
To prescribe the independence of procuratorial power by the constitution is necessary and reasonable for the obstacle factors. The independence of procuratorial power has two aspects of exterior and interior and interior independence relates to the relation between chief procurator and the prosecutors. The independence of procuratorial power is relative, and the lead of the Party and supervision of people's congress should be regarded.
