消费环境的安全保障为经营者法定安全义务之附随义务．经营者是否违反这一义务应以诚信原则作为衡量和判断的基本标准。以过错责任作为归责原则，要防止对经营者的过度归责倾向。
To provide a safe consumption environment is an attached obligation of the proprietor to legal obligations,which should be measured by the principle of trustworthiness.The principle of liability is based on fault.Excessive liability of the proprietor should be prevented.
