论我国行政复议管辖体制的缺陷及其重构

行政复议管辖体制是行政复议制度的核心问题之一 ,其设定是否科学合理直接影响到行政复议法的立法宗旨能否实现。而我国现有的行政复议管辖体制存在着重大缺陷 ,不利于行政复议案件的公正裁决和相对人合法权益的有效保护 ,应加以改造和重构。建议通过在县级以上各级人民政府设立统一的行政复议委员会 ,由其专司行政复议职能 ,改变行政复议机关林立、机构分散与不独立的现状 ,以促使行政复议质量的提高与复议功能的发挥。

Administrative reconsideration jurisdiction is one of the key issues in the system of administrative reconsideration. Whether it is scientifically and rationally defined has a direct impact on the realization of legislative objective of the law on administrative reconsideration. Having serious defects, the current system of administrative reconsideration jurisdiction can not guarantee impartial handlings of cases of administrative reconsideration and effective protection of legitimate rights and interest of parties concerned. The system must be reformed and reconstructed. The authors suggest that unified committees of administrative reconsideration be set up in people's governments above the county level, so to change the status quo in which there are a great number of administrative reconsideration organs affiliated to various departments and all lack independence. The unified administrative reconsideration committees shall perform functions of administrative reconsideration solely, thus to improve the quality of administrative reconsideration and bring the special function into full play.
