On One-sidedness Towards History of Ruling by Law

在研究法学的青年学者中,有一种错误倾向,本文概括为法制历史片面主义,主要表现为对于我国建国以来的法制历史,主要是建国初期的法制历史,只谈问题和错误的一面,不谈成绩和经验的一面,它妨碍和影响了对于新中国法制历史的正确认识和对待,妨碍党的基本路线的贯彻执行。文章分析了法制历史片面主义的具体表现、危害、产生的根源以及提出了避免的措施。

Among the young scholars studying law, there exists a onesided view on the history of ruling by law in our country, of which they would like to dwell upon its mistakes and problems while overlooking its merits and positive experiences. This has greatly misinterpreted our law history and hindered the implementation of our Party's basic line. The paper analyses the onesided view on the law history and the view's harm and the origin of the view and at the same time puts forward some countermeasures as to cope with these views.
