摘要
医患关系是复合型的法律关系 ,需要具体情况具体分析 ;举证责任倒置制度很不合理 ,产生诸多问题应予废除 ;应该重视和加强对医院以及医务人员的权利保护。
The relationship between patient and doctor is a kind of compound legal relationship,which ought to be analysed by fact.The upset burden of proof should be called off because it is unfair and causes many problems. The protection for right of hospital and doctors must be emphasized.
