在制定民法典的过程中,应本着以权利为本位、适应科学技术的发展和经济全球化趋势、鼓励诚实信用的指导思想,在篇章结构上,应按照民法调整的社会关系的个性来构造我国民法,将逻辑性和实用性相结合。应制定物权法而不是财产法,同时分别将人格权法、知识产权法和侵权行为法独立成篇。

The civil code should be drafted under the guiding principle of taking right at its core, making it suited to the development of science and technology and the trend of globalization, and encouraging honesty and credit. In terms of its composition, the civil code should combine logic and practicality in accordance with the nature of social relations as adjusted by civil laws. In addition, the ownership law should be formulated instead of the property law. Meanwhile, the law of personality right, the law of intellectual property right and tort law should be made independent parts in the civil code.
