论诉权的宪法保障

On Protection of Right of Action in Constitution

诉权是当事人享有的宪法上的基本人权。加强对诉权的宪法保障不仅符合现代法治理念的要求 ,而且也顺应了诉权的宪法化、国际化的趋势。应当在我国宪法中明确确认当事人的诉权 ,这有利于促进宪法诉讼在我国的启动。

Right of action is a fundamental human right possessed by parties in constitution.To strengthen protection of right of action in constitution is not only consistent with modem idea of rule of law,but also adapts to the trend which this right has become a constitutional and intermational right in foreign countries.We should acknowledge right of action a citizen's basic right in constitutin.This is helpful to open constitutional proceedings in China.
