摘要
独立性是信用证业务的基本原则,它在提高结算效率的同时,也带来了隐患:出口方单据欺诈。向法院申请禁令是进口方面临欺诈时寻求法律救济的有效方法,但这破坏了独立性原则。禁令的发布应非常谨慎。
Independence is the basic principle in the settlement of Letter of Credit.It causes hidden trouble while it improves the efficiency of settlement:the exporter's fraud in documents.It's an effective relief for the importer to apply for the injunction in the face of such fraud.Considering that the relief will break the principle of independnce,the court should be cautious to issue the injunction.
