论侦查资源的配置与侦查效益

科学的侦查资源配置对于提高侦查效益具有重要意义。在我国当前的侦查体制模式下,侦查资源配置的不合理导致了侦查效益的低下。较高的侦查效益必须建立于合理的侦查源配置的基础之上。当前我国侦查体制中警力资源配置的不足在于侦查机构设置不合理和警力资源投入上的缺乏理性。在刑事诉讼法治的语境下,侦查权力资源的配置必须遵循比例原则和必要性原则。从侦查机关与检察机关在刑事诉讼程序中的关系来看,应当赋予检察机关对侦查的领导权力。从控辩关系来分析,应当赋予犯罪嫌疑人及其律师一定的辩护性调查权力。在现代社会里,要拓展侦查资源,充分利用现代技术,建立信息资源共享系统,从而提高侦查效益。

Scientific disposition of investigation resources is of great significance to increase investigation benefits. In the present mode of investigation system, unreasonable disposition of investigation resources results in less benefits. Greater investigation benefits rely on rational disposition of investigation resources. Presently, the defects in the disposition of police resources include unreasonable disposition of investigation organization and investment of police resources. Constitutionality of criminal lawsuit requires that disposition of investigation resources follow the principle of proportion and that of necessity. Viewed from the relations of investigation organs and prosecutorial organs in the procedure of criminal lawsuit, prosecutorial organs should be entitled the leading power over investigation. Analyzed from the relations between accuser and defender, a criminal suspect and his lawyer shall have some investigation rights for the defense. In modern society, we must exploit investigation resources, make full use of modern technology, establish sharing system information resource and therefore to gain much investigation benefits.
