设立我国反垄断专门机构的可行性研究

The Possibility of Setting up a antimonoploy Agency

制定《反垄断法》已经成为我国社会各界的共识。我国反垄断立法应以我国垄断的实际情况为依据来制定其具体规范。当前我国反垄断的重点应是行政垄断以及部分自然垄断行业;但从长远来看,反垄断应以经济垄断为主,兼顾行政垄断与自然垄断。我国反垄断立法的垄断控制制度应采"行为主义为主,结构主义为辅"的原则。为有效实施反垄断法,必须设立一个具有高度权威性和独立性的专门机构。

Based on the analysis of all kinds of monopoly in today's China,the legislation of antimonopoly of China should adopt the principle of 'behaviorism is the mainly force.Constructism is the assistant force.'In order to enfore the antimonlopoly law,China should set up a special antimonopoly agency with power and independence.
