On Precontract

预约是当事人之间约定将来订立一定合同的合同 ,其价值在于以当事人约定的形式对合同的订立过程予以规划 ,以合理分配缔约风险、降低缔约成本。从预约的概念与类型、预约的效力与违反预约的责任以及违反预约的责任与缔约过失责任之比较三个方面对预约作分析。

Precontract is an agreement which stipulates that the relevant parties should negotiate for signing a certain contract .It's value lies in planning the process of negotiating for signing a contract, thereby allocating risks and lowering the cost reasonably . This article has three parts:the concept and kinds of precontract; the effect and the liabilities of breaching precontract; a contrast between liabilities of breaching precontract and culpa in contrahedo.
