关于公安机关经济犯罪侦查体制改革的思考

Speculation on the Reform of Public Security Organs' Economic Investigative System

在公安机关内部组建专门的经济犯罪侦查机构,是由经济犯罪不同于普通刑事犯罪的特殊性所决定的,也是适应我国市场经济体制的建立和完善,加大打击经济犯罪力度的必然要求。然而,在目前“条块结合,以块为主”的体制下,经侦工作中的地方保护主义严重、经费不足以及警力量少质弱等问题,严重制约了经侦部门发挥应有的作用,不利于社会主义市场经济的健康发展。经侦体制改革的目标应是实现全国统一的打击经济犯罪刑事执法,建立垂直管理的公安经侦体制。但在这一改革过程中,必须防止克服了“块块”分割的问题,却又导致“条条”分割的问题。

Economic crime differs from common criminal crime and has its specific characteristics. The establishment of special economic crime investigation organization in public security organ aims to conform to our market economy system and reinforce our momentum of cracking down on economic crimes. However, some unfavorable factors under the present system, such as serious local protectionism, lack of financial supply and qualified police force, etc, will affect the economic investigation organization's fulfilling its duty satisfactorily and hinder the healthy development of socialist market economy. This paper points out that the aim of the reform of economic investigative system is to crack down on economic crimes by uniform criminal law enforcement and to set up a vertical management system of public security economic investigation.
