摘要
本文运用法律人类学方法较为全面地论述了西南少数民族习惯法的主要内容 ,充分肯定了民族习惯法的作用与价值 ,并指出了其性质与特点。同时 ,作者结合田野调查的实证材料 ,实事求是地分析了西南少数民族习惯法的历史局限性。
This paper illustrates the main content of the common laws of ethnic minorities in Southwest China, based on legal anthropology. It asserts the roles and values of ethnic minorities’ common laws, and points out their nature and features. Meanwhile, the writer analyses the restraints of the common laws by means of his field work.
