执行宽限——徘徊在刚性与柔性之间

Grace Period between Rigidity and Suppleness

我国执行程序不加区分、无条件地给予债务人宽限 ,实践中执行人员更会随意给予若干宽限。这种宽限的滥用严重损害了债权人的利益 ,损害了执行的效率 ,也使强制执行法本应具有的刚性丧失殆尽。必须将执行宽限严格控制在少数特殊情况之下 ,以张扬强制执行法刚性的一面 ,弱化其柔性的一面。

In China, the execution procedure gives debtors grace period without any distinction and condition. The bailiffs also favor them with many grace periods casually. Those grace periods have severely harmed the creditor, the efficiency of procedure, and made enforcement procedure lose its rigidity. Therefore, granting grace period must be limited on some special occasions, so that we could strengthen rigidity and weaken suppleness of law in execution procedure.
