单位累犯制度之提倡及立法建议

A Proposal for the Legislation of Unit Recidivism

我国刑法典中没有规定单位累犯制度 ,在我国刑法中增设单位累犯不仅有现实的必要性 ,更具有理论的可能性。单位累犯是一种刑罚制度 ,在对其定义时 ,要注意与构成累犯的单位定义的区别。文章在分析单位累犯构成特征和处罚原则的基础上 ,提出单位累犯的立法建议。

There are no regulations about unit recidivism in China Criminal Code, therefore, it is necessary to supplement unit recidivism to criminal laws. Unit recidivism is a kind of criminal penalty systems, while defining unit recidivism, we should distinguish it form the definition of units which made offence with a records. Through analyzing the composing characters and the principles of penalty of unit recidivism, the author put foreword the proposal for the legislation of unit recidivism.
