我国涉外服务贸易立法的现状分析

The Study on International Law of Trade in Service

随着我国涉外服务贸易的不断发展 ,服务贸易法律规范正成为法学界的一个研究热点。但是 ,服务贸易法作为独立的法学分支 ,仍然处于萌芽阶段 ,无论是理论基础还是现实规范 ,都表现出一定的薄弱性和复杂性。本文以我国现有的服务贸易法规范的存在现状和理论地位为重点 ,对涉外服务贸易法的发展现状和今后趋势进行分析 ,以期对我国涉外服务贸易法有一个理性的认识与总结。

With developing of trade in service, the study on international law of trade in service is a focus in legal theory circles. However, it is weak and complex in the theory and the legal rules for law of service trade, which is developing in pullulating phase as an independent legal branch. The article is expected to be helpful to realize and generalize present situation of the law of service trade through study on the development of the rules respected service trade.
